These TrakIntel Terms of Use (also referred to as “Terms”, “Terms of Service”, or “Terms of Use”) constitute a legally binding agreement between you (“you”, “User”) and TrakIntel (“TrakIntel”, “we”, “us”, or “our”) governing your access to and use of the services, platforms, tools, content, and features that we provide (the “Platform” or “Services”). The Platform includes, but is not limited to:

• APIs, dashboards, tools, integrations, and other software interfaces
• Reports, data exports, downloads, and related modules
• Mobile or browser-based applications, browser extensions

• To the maximum extent permitted by applicable law, in no event shall TrakIntel (or its officers, directors, employees, agents, licensors) be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, including lost profits, business interruption, or lost data, even if we have been advised of the possibility of such damages.
• Our total aggregate liability to you under these Terms, from any cause whatsoever, and regardless of the form of action (contract, tort, statute, or otherwise), shall not exceed an amount equal to the fees you have paid (or owe) to us in the twelve (12) months preceding the event giving rise to the claim.
• The foregoing limitations apply even if the remedy fails in its essential purpose.

8. Confidentiality

• Definition: “Confidential Information” means information disclosed by one party to the other that is designated as confidential or reasonably understood to be confidential, including non-public business, technical, financial, strategic information, and data accessed via the Platform.
